Special Council

WHEREAS the Township of Warwick Technical Review Team (TRT) has now completed its 2021 review of the Waste Management of Canada Corporation (Will) Twin Creeks Landfill Report for the 2020 reporting year; AND WHEREAS Township Council have now reviewed and considered the draft 2021 TRT Review and recommendations with respect to this matter; BE IT RESOLVED THAT the Township hereby directs that Garrod Pickfield LLP, its environmental solicitors, forward a copy of the draft Township of Warwick 2021 TRT Review on to WM, for review, discussion with TRT members requested by WM, and WM response; AND THAT Township Council directs that the following be requested of WM by letter from Garrod Pickfield LLP to WM on behalf of the Township: 1. That WM implement all of the recommendations of the landscape inspection report included as Attachment 1 to the draft 2021 TRT Review; 2. That WM be advised that the present $40,000.00 letter of credit in favor of the Township to cover outstanding landscaping items should be reduced to $5,000.00; 3. That WM review and address all of the specific comments and recommendations set out in the draft 2021 TRT Review pertaining to ground and surface water quality, landfill engineering, noise, and air quality and dust management provided as Attachments 2 — 5 of the draft2021 TRT Review; 4. That WM review and address all of the specific comments and recommendations set out in the William Day Financial Audit for the 2020 reporting year provided as Attachment 6 o

THAT Warwick Township Council moves into an In Camera meeting of Council pursuant to Section 239 of the Municipal Act, 2001, as amended, for the following reasons: ii) A matter regarding personal matters about an identifiable individual, including municipal or local board employees - Section 239(2)(b); iii) A matter regarding proposed or pending acquisition or disposition of land by the municipality or local board - Section 239(2)(c); vi) Advise that is subject to solicitor-client privilege , including communications necessary for that purpose - Section 239(2)(f); xi) A position, plan, procedure, criteria or instruction to be applied to any negotiations

THAT Warwick Township Council reconvenes in open session. -

BE IT RESOLVED that Council directs that the Mayor and Township Chief Administrative Office execute a memorandum of understanding for the purposes of setting out certain principles that will guide the Waste Management of Canada Corporation (WM) and the Township in their dealings with respect to the Township’s independent multi-disciplinary peer review of the proposed WM Landfill Expansion Environmental Assessment, substantially in accordance with the draft memorandum of understanding attached hereto, to the satisfaction of the Mayor, Township Chief Administrative Office and the Township solicitor with respect to this matter. -

THAT By-law number 87 of 2021 be read a first and second time. -

THAT By-law number 87 of 2021 be read a third time and finally passed. -

THAT Warwick Township Council hereby adjourns. -
