WHEREAS the Waste Management of Canada Corporation (WM) Twin Creeks Landfill has commenced an environmental screening process for approval of a proposal to increase the current annual maximum fill rate for the WM Twin Creeks Landfill from 750,000 tonnes to1.4 Million tonnes (“Proposed Fill Rate Increase”); AND WHEREAS the Township has now received and reviewed final peer review comments, prepared by the Township’s Technical Review Team (“TRT”), on the environmental screening process and amended reports/ studies provided out by WM on this proposal; AND WHEREAS the TRT has concluded that, based on final technical responses provided by the WM project team, and provided that WM commitments as set out in the dated February 13, 2017 from WM to the Township are fulfilled, the TRT is now satisfied that the proposal fill rate increase will not cause unacceptable environmental and nuisance impacts and can be supported from a technical perspective; AND WHEREAS WM by letter dated February 13, 2017, has also made certain specific commitments to address Township concerns with respect to long term leachate management and frequency of independent environmental inspections at the Landfill; BE IT RESOLVED THAT the Township hereby directs that it’s Environmental Legal Counsel, Garrod Pickfield LLP forward the attached report providing the TRT’s final comments and recommendations on the proposed fill rate increase to WM; AND THAT that WM be advised that the Township has no objection to the Propo
